MEDIATIONS AND ARBITRATIONS

maintains a very active practice in the field of
mediations and arbitrations. Three members of our firm
serve as mediators and arbitrators in various types
of civil disputes including: divorce and
post-dissolution matters, commercial contracts,
construction, insurance coverage, medical
malpractice, motor vehicle accidents, premises
liability, products liability, and personal injury
and wrongful death actions.
Mediation is a popular means for parties to resolve
their disputes. Mediations generally reduce the time
and cost involved in litigation. In mediation, a
neutral third party, the mediator, helps the parties
reach an agreement. Unlike traditional litigation,
the parties are actively involved in the
decision-making process and every decision requires
unanimous consent of the parties.
Another alternative dispute resolution method is
arbitration. Unlike traditional litigation,
arbitration is less formal, less expensive, and a
more private way for parties to resolve their
disputes. In arbitration, the parties present their
evidence in the form of documents and witness
testimony to a private attorney or arbitrator who,
at the conclusion of the arbitration, renders a
decision, which becomes binding upon the parties. |
